The following Crumbl® Gift Card and Vouchers Terms and Conditions ("Agreement") describes the terms and conditions that apply to your purchase, acceptance, and use of any Gift Card or Voucher. The Gift Card can come in two forms: (i) a physical Gift Card; and (ii) an electronically transmitted eGift Card. The Voucher can come in two forms: (i) a physical card; and (ii) an electronically transmitted eVoucher. In this Agreement, the term "Gift Card" and "Voucher" may be used interchangeably to refer to both the physical Gift Card or Voucher and the eGift Card or Voucher, except where indicated otherwise.
"Crumbl" means, collectively, Crumbl Canada, Inc., its parent company, subsidiaries, affiliates, franchisees and the officers, directors and employees of each.
By purchasing, accepting, or using your Gift Card or Voucher, you agree to be bound by this Agreement, the Crumbl Privacy Policy, and, as applicable, the Terms and Conditions. If you do not agree with this Agreement, the Crumbl Privacy Policy, or the Terms and Conditions, then do not purchase, accept, or use the Gift Card or Voucher.
You agree that Crumbl may provide notices, disclosures and amendments to this Agreement, and other information relating to your Gift Card or Voucher by electronic means, including posting such materials online at crumblcookies.ca.
Gift Cards are available for purchase at participating Crumbl locations in Canada. Gift Cards may also be purchased from authorized third-party retailers in Canada. eGift Cards are available for purchase on the Crumbl App or at crumblcookies.ca/gifting/giftcards. The Gift Card is a Crumbl Gift Card that can be loaded with a dollar value and used to purchase goods and services at participating Crumbl locations in Canada. Gift Cards purchased from authorized third-party retailers may not be reloadable.
The Gift Card may not be used to purchase other Gift Cards and is not redeemable for cash except as required by law. The Gift Card balance never expires, nor are any fees charged in connection with its use. The Gift Card is not a credit or debit card, and no credit card, overdraft protection, deposit account, or depository insurance is associated with it.
Vouchers are available for purchase at participating Crumbl locations in Canada. The Voucher cannot be loaded with a dollar value and can only be used to purchase the pre-determined good at participating Crumbl locations in Canada.
The Voucher is not redeemable for cash except as required by law. Vouchers do not expire, nor are any fees charged in connection with its use. The Voucher is not a credit or debit card, and no credit card, overdraft protection, deposit account, or depository insurance is associated with it.
Gift Cards and Vouchers are not refundable or redeemable for cash unless required by law. You may not return or cancel your Gift Card or Voucher after it is received. Certain authorized third-party retailers may support alternative refund policies specifically for Gift Cards, so check with the retailer from whom the Gift Card was purchased. Crumbl is not responsible for these alternative policies. Vouchers are not refundable unless required by law. Crumbl does not sell Vouchers from any authorized third-party retailers.
You will not be sent statements of itemized transactions relating to your use of your Gift Card. You may check your balance on the Crumbl App or at participating Crumbl locations in Canada. The balance you receive when inquiring is an estimate only based on currently available transaction data. In most cases, the balance is adjusted immediately when you make a purchase, but there may be occasions when the balance adjustment is delayed.
Crumbl reserves the right to adjust and correct the balance on your Gift Card in the event we believe that an administrative, accounting or billing error has occurred. Crumbl shall have no liability for any billing error unless you provide us notice within sixty (60) days of the date of the transaction in question. Please monitor your transactions and card balances closely.
Your Gift Card or Voucher is redeemable only for purchases of goods and services at participating Crumbl locations in Canada. eGift Cards require the Crumbl App to purchase goods and services at participating Crumbl locations in Canada. The Gift Cards and Vouchers have no cash value and may not be redeemed for cash (except as required by law). While most of the Crumbl locations in Canada accept the Gift Card for payment and the Voucher for redemption of goods, Crumbl cannot guarantee acceptance at all locations. Your Gift Card or Voucher must be presented at the time of order. Gift Cards or Vouchers may not be resold without the prior consent of Crumbl.
Gift Cards and Vouchers are not targeted towards, nor intended for use by, anyone under the age of 13. If you are between the ages of 13 and 18, you may only use your Gift Card or Voucher under the supervision of a parent or legal guardian who agrees to be bound by this Agreement.
Your Gift Card or Voucher does not expire. No inactivity, service or any other fees will be charged. However, Crumbl reserves the right to refuse to honor (and to cause participating Crumbl locations to refuse to honor) any Gift Card or Voucher in the event of a disputed credit card charge or if Crumbl reasonably believes the use is unauthorized or unlawful. Crumbl is not responsible for any unauthorized sale of Gift Cards or Vouchers, nor is Crumbl responsible for any third-party fraud or unlawful activity associated with any Gift Card or Gift Card balance or Voucher. If Crumbl discovers any Gift Card or Gift Card balance or Voucher was sourced or derived through fraud or other unlawful or unauthorized means, Crumbl may, in its sole discretion, cancel all impacted Gift Cards or Vouchers and retain all related Gift Card balances without notice to you.
You are responsible for all transactions associated with your Gift Card or Voucher, whether authorized or unauthorized. You should, therefore, safeguard your Gift Card or Voucher and not disclose your Gift Card or Voucher information to anyone. The remaining balance on lost, stolen or damaged cards will not be replaced. Crumbl is not responsible for any unauthorized use of your Gift Card or Voucher.
All Crumbl locations are owned and operated by independent franchisees of Crumbl. Each location is solely and independently responsible for its legal and regulatory compliance.
This provision is intended to be interpreted broadly to encompass all disputes or claims arising out of our relationship. Any dispute or claim made by you against us (or against any of our subsidiary, parent or affiliate companies) arising out of or relating to this Agreement or your use of the Gift Card or Voucher (whether based in contract, tort, statute, fraud, misrepresentation or any other legal theory) will be resolved by binding arbitration except that (a) if an applicable law in your province or jurisdiction of residence gives you the right to resolve your dispute or claim, or part of your dispute or claim before the courts of that province or jurisdiction notwithstanding your agreement to arbitration, you may elect either to bring the eligible parts of your dispute or claim before the courts of that province, or to proceed in arbitration, (b) you may take claims to small claims court if they qualify for hearing by such a court, or (c) you or we may choose to pursue claims in court if the claims relate solely to the collection of any debts you owe to us.
You must first present any claim or dispute to us by contacting us to allow us an opportunity to resolve the dispute. You may request arbitration if your claim or dispute cannot be resolved within sixty (60) days. The arbitration of any dispute or claim shall be conducted in accordance with the Arbitrations Act (Ontario) as modified by this Agreement. The arbitration may take place in person in Toronto, Ontario, or via tele/video conference, and will be conducted in the English language. An arbitrator may not award relief in excess of or contrary to what this Agreement provides, order consolidation or arbitration on a class wide or representative basis, or award punitive damages or any other damages aside from the prevailing party's actual damages, except that the arbitrator may award on an individual basis damages required by statute and may order injunctive or declaratory relief pursuant to an applicable consumer protection statute. Any arbitration shall be confidential, and neither you nor we may disclose the existence, content or results of any arbitration, except as may be required by law or for purposes of enforcement of the arbitration award. Judgment on any arbitration award may be entered in any court having proper jurisdiction. If any portion of this arbitration clause is determined by a court to be inapplicable or invalid, then the remainder shall still be given full force and effect. All administrative fees and expenses of an arbitration will be divided equally between you and us. In all arbitrations, each party will bear the expense of its own counsel, experts, witnesses and preparation and presentation of evidence at the arbitration.
By entering into this Agreement, both you and Crumbl are waiving certain rights to litigate disputes in court. If for any reason this arbitration clause is deemed inapplicable or invalid, you and Crumbl both waive, to the fullest extent allowed by law, any claims to recover punitive or exemplary damages and any right to pursue any claims on a class or consolidated basis or in a representative capacity.
SOME PROVINCES/JURISDICTIONS, SUCH AS QUEBEC, DO NOT ALLOW THE LIMITATION OF IMPLIED WARRANTIES OR LIMITATIONS OF LIABILITY/DAMAGES, SO THIS MAY NOT BE APPLICABLE TO YOU. CRUMBL MAKES NO REPRESENTATIONS, WARRANTIES OR CONDITIONS OF ANY KIND, EXPRESS OR IMPLIED, WITH RESPECT TO THE GIFT CARD OR VOUCHER, INCLUDING, BUT NOT LIMITED TO, ANY IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABLE QUALITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT, OR ANY WARRANTY ARISING BY USAGE OF TRADE, COURSE OF DEALING OR COURSE OF PERFORMANCE. CRUMBL DOES NOT REPRESENT OR WARRANT THAT YOUR GIFT CARD OR VOUCHER WILL ALWAYS BE ACCEPTED OR THE GIFT CARD OR VOUCHER WILL ALWAYS BE ACCESSIBLE. IN THE EVENT THAT CRUMBL OR ITS AFFILIATES ARE FOUND LIABLE TO YOU, YOU SHALL ONLY BE ENTITLED TO RECOVER ACTUAL AND DIRECT DAMAGES AND SUCH DAMAGES SHALL NOT EXCEED THE LAST BALANCE HELD ON YOUR GIFT CARD OR VOUCHER PRIOR TO THE TIME AT WHICH SUCH DAMAGES AROSE. CRUMBL AND ITS AFFILIATES SHALL HAVE NO LIABILITY FOR ANY INCIDENTAL, INDIRECT, CONSEQUENTIAL, SPECIAL OR PUNITIVE DAMAGES (INCLUDING WITHOUT LIMITATION LOSS OF PROFIT, REVENUE, USE OR DATA) ARISING OUT OF OR IN ANY WAY CONNECTED WITH THIS AGREEMENT, WHETHER IN CONTRACT (INCLUDING FUNDAMENTAL BREACH), WARRANTY, TORT (INCLUDING NEGLIGENCE, WHETHER ACTIVE, PASSIVE OR IMPUTED), PRODUCT LIABILITY, STRICT LIABILITY OR OTHER THEORY, EVEN IF WE OR OUR AUTHORIZED REPRESENTATIVES HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL CRUMBL OR ITS AFFILIATES HAVE ANY LIABILITY FOR UNAUTHORIZED ACCESS TO, OR ALTERATION, THEFT OR DESTRUCTION OF A CRUMBL GIFT CARD OR VOUCHER THROUGH ACCIDENT, MISUSE, OR FRAUDULENT MEANS OR DEVICES BY YOU OR ANY THIRD PARTY, OR AS A RESULT OF ANY DELAY OR MISTAKE RESULTING FROM ANY CIRCUMSTANCES BEYOND OUR CONTROL.
The laws of the Province of Ontario, Canada, notwithstanding any conflict of law rules, apply to this Agreement and use of your Crumbl Gift Card or Voucher, except to the extent that this agreement is governed by the consumer protection legislation of your province/jurisdiction. If any part of this Agreement is unlawful, void, or unenforceable, that part will be deemed severable and will not affect the validity and enforceability of any remaining provisions.
Crumbl reserves the right to change this Agreement from time to time in its discretion, which changes Crumbl may provide to you by any reasonable means, including without limitation, by posting the revised version of this Agreement at crumblcookies.ca ("Updated Terms"), or as required by law. Your use of your Gift Card or Voucher after Crumbl has posted the Updated Terms constitutes your agreement to the Updated Terms. The Updated Terms will be effective as of the time of posting, or such later date as may be specified in the Updated Terms and will apply to your use of your Gift Card or Voucher from that point forward.
